Plaid Term of Service

1. These Terms of Use (“Terms”) govern your use of “Swap By Vitalswap”(Swap App) operated by VitalSwap LLC when you use the Swap App on any mobile phone, tablet, watch or other device (“Device”) that supports the Swap App. These Terms are a legal agreement, so please read them carefully. The words “you” and “your” mean a Swap App customer or authorized user, and the words “we”, “us”, “our”,”Vitalswap” and “Swap App” mean VitalSwap, Swap App.
2. Terms that apply
   In addition to these terms, you agree that when you use Swap App, you will remain subject to the terms and conditions of all your existing agreements with Vitalswap.
3. Changes to Terms
   Vitalswap may modify these Terms at any time. Your continued use of your Services through Swap App will indicate your acknowledgment of, and intent to be bound by, any modifications made subsequent to your initial acceptance of these Terms.  
4. Privacy
   Any personal information provided to us shall be subject to the terms and conditions of our privacy policy.
5. Unauthorized Use
   You agree not to use or allow others to use your Swap App in any way that would violate any agreement you have with us, including, but not limited to, any prohibition on fraudulent or illegal activity contained in the agreement(s) governing your use of the Swap App. If you permit other persons to use your Swap App, you are responsible for any transactions they authorize to the extent permitted by applicable law and the agreement(s) controlling the Card.
6. Account Ownership/Accurate Information
   You represent that you are the legal owner of the account and other financial information which is provided to Vitalswap. You represent and agree that all information you provide in connection with the Swap App is accurate, current, and complete, and that you have the right to provide such information to us for the purpose of operating the Swap App. You agree not to misrepresent your identity or your account information. You agree that we may decide to block, deactivate or restrict your access to the use of Swap App if you violate any of our policy. Providing false information may cause your bank or payment processor to hold your funds. You agree to resolve such misrepresentation with your bank or payment processor
7. Support
   If you have a Swap App, please call us at 725-234-0077 for support related to your Swap App or if your device is lost, stolen or compromised
8. Third-party Fees
   You are responsible for any fees charged by any third party in connection with your use of a Swap App, including, without limitation, your mobile telephone service provider, Internet provider.
9. Promotion, Referrals and Other Bonus
   Vitalswap shall pay promotional, referrals and other bonus (referred to as bonus) to you solely at the discression of Vitalswap and will not be responsible for any cost incured by you to obtain such bonus.
10. Severability Clause
    If any term, provision, covenant or condition of these Terms is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions of these terms shall remain in full force and effect and shall in no way be affected, impaired or invalidated.
11. You agree to allow us to contact you electronically
    You agree to receive electronic communications from us, including emails, phone call and sms to the email address you have provided in connection with your Swap App account. These electronic communications will relate to your use of the Swap App. You agree to update your email address when it changes by contacting us using the contact information in your Account Agreement. You may also contact us if you wish to withdraw your consent to receive these electronic communications, but doing so may result in your inability to continue to use Swap App.
12. We may block, suspend, or cancel your use of services on Swap App
    We may block you from creating swap deals, depositing to your Swap App Wallet, suspend your ability to use Swap App to make purchases, Swaps, or cancel entirely your ability to continue to use Swap App. We may take these actions at any time and for any reason of your inappropriate use of the app which include, engaging in illegal transactions on the app, if we suspect fraud with your use of Swap App, if you have an overdue or negative balance on your Swap App, or if applicable laws change.
13. Security of the Wallet
    In addition to your efforts to keep your credentials secure, we take reasonable steps to help ensure that information we send to third-party from your use of Swap App is sent in a secure manner. However, the third party service provider is responsible for the security of information provided to it. 
14. Tax and local laws
    As required by your local laws, you are responsible for fulfilling tax obligations in the country you operate wallet for its currency.
15. Account security
    Security on our platform is a shared responsibility. While we ensure that your data is secured at rest and transit, it is your responsibility to protect your credentials and devices from Unauthorized usage. We assume all transactions initiated by your device are authorized by you.
16. Zelle
    Partner's Disclosure: You are sending funds to ABetaGlobal LLC. ABetaGlobal LLC is a related party service provider to VitalSwap LLC. ABetaGlobal is *not* a bank or payment processor. Funds sent to ABetaGlobal are custodied at banks that are FDIC insured. After funds sent are received and settled by ABetaGlobal, VitalSwap LLC will credit the corresponding user account. We will decline funds sent from bank accounts that are not connected to your VitalSwap user account. Timing: While most transfers will be settled the same day, funds sent to ABetaGlobal may take upto 2 days for settlement. We cannot estimate or guarantee exact timing of when funds will be available, due to varying settlement for transfers from each bank. Learn more about Zelle's User Service Agreement.
17. Negative Balances,charges and overdrafts
    You agree to refund Vitalswap of all negative balances in your Swap app wallets maintained by vitalswap via the swap app mobile app and you authorize Vitalswap to charge your bank account for all negative balance in your wallet. In the event that you incur overdraft charges in your bank account as a result of charging the account you provided to us, you will be responsible for such
18. Refund
    For values not yet consumed, provided or transfered outside of our platform, We will issue a refund at your request on our app or through our help channels.
19. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
    YOU UNDERSTAND AND AGREE THAT YOUR USE OF SWAP APP IS AT YOUR RISK. WE ARE ONLY RESPONSIBLE FOR PROVIDING SWAP APP VIRTUAL CURRENCY EXCHANGES AS EXPRESSLY STATED IN THE AGREEMENT. THERE IS NO GUARANTEE THAT ACCESS TO SWAP APP WILL BE AVAILABLE AT ALL TIMES AND WE SHALL NOT BE LIABLE IF YOU ARE UNABLE TO ACCESS SWAP APP. SWAP APP IS PROVIDED "AS IS" AND, EXCEPT AS PROHIBITED BY LAW, WE, OUR EMPLOYEES,MANAGES,DIRECTORS,SHAREHOLDERS AND OUR THIRD PARTY SERVICE PROVIDERS DISCLAIM ANY EXPRESS OR IMPLIED WARRANTIES CONCERNING SWAP APP, EQUIPMENT OR SOFTWARE, INCLUDING, BUT NOT LIMITED TO ANY WARRANTIES OR USEFULNESS, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT OF ANY PARTIES' PROPRIETARY RIGHTS. IN NO CASE SHALL VITALSWAP OR ANY OF OUR THIRD PARTY SERVICE PROVIDERS BE LIABLE FOR ANY LOSS OF DATA,MONEY, PROFIT, GOODWILL, OR SPECIAL, PUNITIVE, INDIRECT, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE SUFFERED BY YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT, SWAP APP, THE SOFTWARE, THE EQUIPMENT OR SWAP APP WALLET WHETHER OR NOT SUCH CLAIM FOR DAMAGES IS BASED ON TORT OR CONTRACTOR OR WHETHER WE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SHOULD HAVE KNOWN OF THE LIKELIHOOD OF SUCH DAMAGES, EXCEPT AS MAY BE REQUIRED BY LAW. IN STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INDIRECT SPECIAL OR CONSEQUENTIAL DAMAGES, SWAP APP AND OUR THIRD PARTY SERVICE PROVIDERS' LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.
